Collaborative law has caught on very quickly in Germany. At the same time, people realized that the term “collaborative law” does not translate well into the German language. The term’s literal translation means something like “conspirative law”, and attempts to establish a common German term have not been entirely successful. The latest idea is to call it “Kokon-Verfahren”. The literal translation of “Kokon-Verfahren” into English is “cocoon process”. “Co coon” because it’s a method of cooperative conflict resolution and because the disqualification agreement, which serves to contain the dispute resolution process, works like a cocoon that at first binds a larva but ultimately yields a gorgeous outcome.
